If you’re buying a property in England or Northern Ireland with the intention to rent it out, you’ll need to pay close attention to buy to let Stamp Duty Land Tax (SDLT). The rules for stamp duty and buy-to-let properties are not the same as for standard residential purchases. In most cases, landlords face significantly higher SDLT rates, and this additional cost can have an impact on your investment budget.

What Is Stamp Duty and Why Is It Higher for Buy-to-Let? 

Buy to Let Stamp Duty Land Tax (SDLT) is a tax that must be paid when you buy property or land in England or Northern Ireland. While standard residential purchases have their own thresholds and exemptions (such as first-time buyer relief), these do not apply to most landlords. 

Since April 2016, the government has introduced a higher rate of Stamp Duty for people buying an additional residential property. This includes second homes, buy-to-lets, holiday homes and any property purchased in addition to your main residence. 

In short, if you already own property and are purchasing another, you are likely to be charged a buy to let Stamp Duty surcharge on top of the standard rate.

Who Has to Pay Buy to Let Stamp Duty? 

The surcharge applies to most buy-to-let purchases where: 

  • The property is worth more than £40,000 
  • The buyer already owns another residential property anywhere in the world 
  • The purchase is not a replacement for the main residence

Married couples and civil partners are treated as one unit. If one of you owns a home, and the other tries to purchase a buy-to-let property, the surcharge will still apply. 

You will still have to pay this additional tax even if your main home is abroad, or if the buy-to-let property is in someone else’s name, but you’re jointly considered owners. 

Stamp Duty Rates for Buy to Let Properties (2025) 

The table below shows the current SDLT rates for additional residential properties, including buy to let investments:

Buy to Let buyers pay higher SDLT rates due to a mandatory 3% surcharge applied on top of standard rates:

Example: For a company buying a buy to let property worth £600,000:

  • 5% between £0 – £125,000 = £6,250
  • 7% between £125,001 – £250,000 = 8,750
  • 10% between £250,001 – £925,000 = £35,000
  • Total SDLT owed: £50,000.
 

When Do You Pay Buy to Let Stamp Duty?

You must pay Stamp Duty within 30 days of completion. Your solicitor will usually file the SDLT return with HMRC on your behalf and arrange payment from your funds.

You can’t delay this payment or pay in instalments. Failing to pay within the deadline can result in penalties and interest.

Can You Avoid the Buy to Let Stamp Duty Surcharge?

In general, no. If you are purchasing an additional residential property above £40,000, the higher rate will apply. However, there are a few exemptions, including:

  • Transfers due to divorce or dissolution
  • Caravans, mobile homes, and houseboats
  • Inherited properties (if transferred via a will)
  • Freehold properties under £40,000
  • Leases under 7 years or valued at less than £40,000 with annual rent below £1,000
