Today we’ll discuss some of the common pitfalls to avoid when buying property in the UK.
Buying property in the UK can be an exciting journey, but it’s important to be aware of the common pitfalls that could derail your plans.
One of the most common pitfalls is failing to conduct a thorough property survey. A comprehensive survey can uncover potential issues such as structural defects or dampness that may not be immediately visible.
Clients are often put off by the cost of obtaining a survey, but should issues be identified with the property, the results of a survey can often be used to renegotiate the price or seek an agreement from the seller that they will undertake the works. Indeed, a negative survey may even dissuade you from purchasing the property altogether.
Clients often assume that surveys are only required for freehold properties. However, it is equally as important when considering buying a flat, as a survey could flag up the requirements for major works to the building, which in turn would lead to an increase in your service charge payments, and of course noise and disruption, just as you would want to enjoy your new home.
It is also crucial to ensure all legal aspects of the property purchase are properly addressed. This includes reviewing contracts, conducting searches and verifying property ownership. The job of a property solicitor is more than just an administrator. Our job is to ensure that you are fully aware of issues with the property you are purchasing. from advising you on any restrictive covenants which will prohibit any development plans you had, to look into whether past building works have the necessary consent and considering whether you will obtain a marketable title to the property.
These are just a few examples. The issues we look out for are infinite with the ultimate goal being to ensure you know exactly what you are buying. You also have a big part to play in the due diligence process. As solicitors do not visit properties, we need our clients to report back to us following visits to the property where, for example, there is a piece of land within the garden which is not included in the title plan or where a third party would appear to have a right of way over the garden which does not show in the title documents and has not been mentioned by the seller. It is very much a joint exercise.
