Notable Cases:
1. Acting for a wife within a financial remedy case whereby a Pre-Nuptial Agreement entered into by the parties almost 20 years ago stated that the husband’s wealth was c.£60M net, originating from international assets. During proceedings, the husband asserted his wealth had diminished to between £13M and £20M, significantly reducing what the wife’s entitlement under the Pre-Nuptial Agreement would have been. Complex arguments were ran involving non-disclosure by the husband to increase the award received by the wife.
2. Acting for a father in the High Court involving the abduction of a child to Belarus and obtaining orders to freeze the mother’s bank accounts and an order for return of the child to the jurisdiction of England and Wales
3. Acting for a wife within financial remedy proceedings whereby a personal investigator was engaged to track and trace hidden assets by the husband across multiple jurisdictions, including UAE, Russia, Spain and Lithuania. The case involved cryptocurrency, a family home owned by a corporate entity and foreign business assets.
4. Acting for the intervenor son within his parent’s financial remedy proceedings whereby his father had sold him one of his properties. The father/husband sought to argue that the sold asset should be added back into the divorce case as being a matrimonial asset under S.37 MCA. We successfully argued that it was not open to the individual who has dissipated an asset to apply under S.37 and achieved a dismissal of the application with a costs order in our client’s favour, and him retaining his property. Subsequently, we have been instructed by the wife in these proceedings, favouring our firm over her then Solicitors.
5. Acting for a father within Child Arrangement proceedings whereby the mother removed the child from the father’s care, made allegations of sexual and domestic abuse and sought injunctions preventing our client (the father) from having any contact with the mother or the child whatsoever. This case involved an international element with concerns regarding the removal of the child out of the jurisdiction. The matter also includes allegations against third parties and we have successfully prevented them being brought in as intervenors and had all allegations of sexual abuse struck out and had contact between our client and his son resume after some 4 months of no contact.
6. Acting for an intervenor regarding the claim of her beneficial interest within a property legally owned by her daughter and son-in-law. We were successful in proving that our client’s contribution towards the property was not a gift and that although her interest in the property was not registered at the Land Registry, that she be recorded as an owner, which in turn reduced the son-in-law’s claim against her daughter in their divorce proceedings. We were also successful in obtaining a cost order against the son-in-law for his disputing of our client’s claim.
7. Acting for a client in his claim against his ex-partner (un-married) for his contributions towards her property (c.£80k worth of renovations) pursuant to the Trusts of Land and Appointment of Trustees Act 1996 (TOLATA). We were successful in proving his beneficial interest, resulting repayment of his contribution.
8. Acting for a father in a Specific Issue Application under child arrangements proceedings regarding the school arrangements for the child.
9. Acting for a wife in a Legal Services Payment Order Application and Maintenance Pending Suit Application to provide her with legal fees and maintenance by the husband throughout proceedings. Both applications were successful resulting in a lump sum of £30,000 for her legal fees and £7,000 per month in maintenance until conclusion of the proceedings.
10. Acting in a case involving the instruction of a single joint expert for a psychiatric assessments on the wife’s earning and income capacity following a decline in her mental health, resulting in her being unable to work due to domestic violence and a criminal conviction against the husband.
