What is a Lasting Power of Attorney?

A LPA (Lasting Power of Attorney) allows you to appoint someone of your choice with the legal right to deal with your affairs if you lose mental capacity. There are two types of LPA:

  • A Personal Welfare LPA – covers decisions about your health and care and are only effective once registered and after mental capacity is lost.
  • A Property and Financial Affairs LPA – allows the person you have chosen to handle your property, bank accounts, bills and investments. These can take affect as soon as they are registered but do have strict guidelines in place to prevent financial abuse.

When it comes to Lasting Powers of Attorney, it’s vital that you seek experienced help to ensure that:

  • The right details are completed so that the LPA is valid – a rejection can result in extra costs.
  • The right powers are given to the right people.
  • The right information is given about your wishes, so your attorney can carry them out properly.

Our specialist solicitors at Starck Uberoi have a wealth of experience and would be happy to help you plan ahead.
