James Incledon, a Partner in the Civil and Commercial Dispute Department and is a talented litigator and negotiator, utilising his extensive High Court experience to serve clients, including high-profile billionaires and corporate entities, as well as being instructed by trustees, politicians, family offices and government organisations. James’ approach is to provide a personal and private service, and he is often instructed in reputational management matters involving injunctive action and media management.

James has a wealth of experience in all aspects of Financial Remedy and his extensive work in civil law is hugely advantageous in cases involving interveners, complex or high value property and business assets. James works closely on most family matters with our Neve Chacksfield, who is an exceptional Senior Associate talented in both financial remedy and children matters.
Notable Cases
· Acting in obtaining injunctive orders preventing media publications relating to a prominent billionaire and his family, working with world leading Kings Counsel.
· Instructed in relation to the defence of claim for over circa £14 million in a claim by lender seeking to exercise power under a Personal Guarantee against the estate of the Guarantor, who is well known Billionaire.
· Acting in multiple Unfair Prejudice and Derivative Claims, including a recent high value trial held over 2 weeks, which also feature dispute as to beneficial share ownership.
· Regularly instructed by a multi-national company in relation to all areas of corporate governance and disputes, including advice on Unfair Prejudice and Derivative Claim.
· Leading a case in which the applicant wife asserted material non-disclosure following the husband’s contention that is net worth had reduced by some £80M during the course of the marriage. Disclosure and asset tracing in this matter included trusts in numerous off-shore jurisdictions, super-prime London real estate and business assets.
· Instructed by the petitioner in a cross-jurisdictional divorce with assets in the region of £15M involving. This matter concern assets in Russia, Latvia and England with complex legal arguments concerning whether the parties had in fact reached prior agreement (known as being Xydhias agreed). James conducted the advocacy for many of the hearings due to his specialist experience in jurisdiction disputes.
· Instructed to defend an ex-parte worldwide freezing injunction in excess of £9M further to a claim for breach of commercial contract.
· Acting in relation to a disputed development agreement concerning various jurisdictions in excess of €50M.
· Contesting jurisdiction in a HNW divorce, further defending applications for Legal Services Provision Orders and Maintenance Pending Suit.
· Advancing Beneficial Interest Claims on behalf of the Applicant Wife in relation to shareholdings and multiple properties, further advancing applications for Legal Services Provision Orders and Maintenance Pending Suit in a matter involving multiple Intervenors.
