This matter concerns the enforcement of a charge against a family home of significant value, likely in excess of £3m, purportedly executed by the wife of a business man. The charge was to secure monies advanced for the purchase of a large property portfolio on behalf of another family member. Arguments have been advanced with the assistance of counsel from New Square Chambers as to the validity and enforceability of the charge and as yet an application an order for sale has been resisted.
